1. Introduction
IMPORTANT NOTICE:
These Terms of Use contain an arbitration agreement, a waiver of your right to participate in class and collective actions, and a waiver of your right to a jury trial, which affect your legal rights. In arbitration, there is no judge or jury, and there is generally less discovery and appellate review than in court. You have the opportunity to opt out of the arbitration agreement as explained below. Please read these provisions carefully.
By accessing or using the Deaf International Basketball Federation (“DIBF”) website, platforms, applications, or other services (collectively, the “Services”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our Services.
These Terms of Use may be amended, modified, or supplemented at any time. Any changes will be posted on this page, and your continued use of the Services after such updates constitutes your acceptance of those changes. Please review these Terms periodically to stay informed about any updates.
2. Acceptance of Terms
Your use of the Services constitutes your acceptance of these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Arbitration Agreement, Class Action, and Jury Trial Waiver
THESE TERMS OF USE CONTAIN AN ARBITRATION AGREEMENT, A CLASS AND COLLECTIVE ACTION WAIVER, AND A JURY TRIAL WAIVER THAT AFFECT YOUR RIGHTS. IN ARBITRATION THERE IS NO JUDGE OR JURY AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. YOU HAVE AN OPPORTUNITY TO OPT OUT OF THE ARBITRATION AGREEMENT AS SET FORTH BELOW. PLEASE REVIEW THESE PROVISIONS CAREFULLY.
4. Opt-Out of Arbitration
If you do not wish to be bound by the arbitration agreement, you may opt out by sending a written notice to DIBF within 30 days of your first use of the Services. The notice must include your name, address, and a clear statement that you want to opt out of arbitration.
5. Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services in any way that could damage, disable, overburden, or impair the Services or interfere with any other party’s use and enjoyment of the Services.
6. User Conduct
You agree not to:

Use the Services to harass, abuse, or harm another person;

Post or transmit any content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable;

Attempt to gain unauthorized access to any part of the Services, accounts, or computer systems;

Use automated tools or scripts to access the Services without permission.
7. Ownership and Use Restrictions
All content, information, materials, software, and services provided by DIBF through the Services, including but not limited to text, graphics, logos, images, audio clips, and video clips, are the exclusive property of DIBF or its licensors.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal, non-commercial purposes only.
You agree not to:

Copy, reproduce, distribute, or publicly display any part of the Services without prior written permission;

Use automated means (such as bots or scrapers) to access or collect data from the Services;

Use the Services in any way that could damage, disable, or impair any DIBF server or network.
8. Registration
Certain parts of the Services may require registration and the creation of an account.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree to notify DIBF immediately of any unauthorized use or security breach related to your account.
9. FIBA LiveStats (Statistics)
DIBF may provide access to statistics and data through third-party services such as FIBA LiveStats.
These statistics are provided for informational purposes only and may be subject to errors or delays.
DIBF does not guarantee the accuracy or completeness of these statistics and disclaims any liability arising from their use.
10. Intellectual Property and Notice of Copyright Infringement
All intellectual property rights in the Services and content belong to DIBF or its licensors.
If you believe any content on the Services infringes your copyright, please notify DIBF’s designated copyright agent with the following information:

A description of the copyrighted work you claim has been infringed;

A description of where the infringing material is located on the Services;

Your contact information (name, address, telephone number, email);

A statement that you have a good faith belief that the use of the material is unauthorized;

A statement, under penalty of perjury, that the information you provide is accurate and that you are authorized to act on behalf of the copyright owner.

11. Termination of Service
DIBF may suspend or terminate your access to the Services at any time, without prior notice or liability, for any reason including breach of these Terms.
Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination shall remain in effect.
12. Indemnification
You agree to indemnify, defend, and hold harmless DIBF and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or violation of these Terms.
13. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DIBF DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL DIBF BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
14. Changes to Terms
These Terms may be amended or modified, or new conditions may be imposed, at any time. Any such changes or additions will be reflected by an update of this posting. Please check these Terms periodically for changes. Your continued use of the Services following the posting of changes to these Terms (including the Privacy Policy) will mean you accept those changes and that such changes shall apply to your access and use of the Services after such changes have been posted.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DIBF is headquartered, without regard to its conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for any disputes arising under these Terms.
16. Notice
Any notice to you under these Terms will be sent to the email address you provide during registration or via a notice posted on the Services.
Notices to DIBF should be sent to the contact information listed in Section 18.
17. Miscellaneous

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and DIBF regarding your use of the Services.

Severability: If any provision is found unenforceable, the remaining provisions will remain in full effect.

Waiver: Failure to enforce any right or provision will not constitute a waiver of such right or provision.

Assignment: You may not assign your rights or obligations under these Terms without prior written consent from DIBF.
